Some people have noticed we have had an increase in solicitors in the neighborhood. After consulting with the Hamilton County Sheriff's Department and our HOA Board, I have some information that may answer any questions you may have about solicitors.
First, there is actually no law against soliciting in the county, and no requirement that they register or get any sort of permit. Our community is made up of county streets, so we are not a private neighborhood...that would be some of the gated communities with private roads and gate access only. Our no soliciting signs do very little, they are simply a request. The solicitors know we have those posted as a request, but we have no legal leg to stand on. I think it makes the residents think that soliciting is illegal, but it is not. Once they come up the sidewalk to your house, it is your private property at that point and you can ask them to leave the individual property or you will call the Sheriff, but you cannot make them leave the neighborhood. If everyone would tell them to leave, they would get the idea they will make no progress in our neighborhood and possibly leave.
If you are suspicious that they are here to check out the neighborhood for possible thefts or other suspicious activity, we urge you to call the non emergency number for the sheriff's department and ask a deputy to come and check them out. They cannot ask them to leave if they here for a legitimate reason, which includes sales, charities, and religious solicitations.
